Cory Neal Stucky, 31, of Blooming Prairie, was charged in the suffocation death of his 8-week-old son in July 2015. He had been charged with second-degree manslaughter and child endangerment. He pleaded not guilty to both charges on Jan. 4.

The baby's mother had originally stated she found Stucky passed out on a living room couch with the baby under his arm on July 18, 2015. The boy was not breathing, so the mother said she immediately called 911 and attempted CPR, but efforts to revive the child were unsuccessful. She said Stucky had consumed 24 beers the night before. Later that day he was seen picking up the cans and had a friend dispose of them.

According to KSTP, charges were dismissed on August 29. According to court documents, Stucky and the victim's mother got married in July of this year. She is the only witness to the events and now says she exaggerated what happened. So prosecutors now don't think they could get a conviction. They also said they think the marriage was pushed for by Stucky.
