Former Proctor Football Player Faced Arraignment On Sexual Assault Charges
The former Proctor football player Alec John Baney who is now 18 made his first court appearance yesterday with his parents and attorney by his side via Zoom. He was in court to be arraigned on third-degree criminal sexual conduct against a juvenile victim. The incident occurred on Sept. 7, 2021 after Varsity football practice. The Proctor football season was canceled after news of the assault came to light.
According to The Duluth News Tribune (Subscription Service) "Assistant St. Louis County Attorney Korey Horn filed a motion ahead of Thursday's hearing asking the court to certify Baney to stand trial as an adult. Judge David Johnson ordered a psychosexual evaluation, individual family assessment and certification study to be performed before the court makes that determination."
One of Baney's attorneys Andrew Poole asked the judge to let Baney remain free without any conditions but Judge Johnson decided to place the teen on supervised release. He said:
Given the nature of the offense, I do believe supervised release is appropriate. I think it'll also be helpful for Mr. Baney to have somebody guiding him — a second set of eyes guiding him through the process.
Under Minnesota law, it is usually presumed a juvenile will be certified as an adult if they were 16 or 17 at the time of the offense. But in some extenuating circumstances they may still have their hearing in juvenile court if it serves public safety. Also court records and hearing are public when the offender is 15 or older and charged with a felony. A certification hearing was tentatively scheduled for March 31, pending the completion of the evaluations.
