Red Wing, MN (KROC-AM News) - Conditional bail was set at $10,000 today in the case of a Red Wing man who was shot and wounded in an officer-involved shooting last week.

23-year-old Fernando Carbajal was formally charged today in Goodhue County court with two felonies, third-degree assault and fourth-degree assault on a peace officer, along with a gross misdemeanor count of fourth-degree assault on a peace officer. His conditional bail was set at $10,000.

The criminal complaint describes the events leading up to the officer-involved shooting on the afternoon of November 22. The court document says Carbajal was driving an SUV at a high rate of speed when the vehicle smashed into a light pole in a city parking lot near Bay Point Park. Witnesses called 911 and a Goodhue County Deputy in an unmarked squad car was the first to arrive at the scene.

One witness stated that Carbajal could be heard screaming at the deputy and that "it looked to her that Carbajal was trying to challenge the officer to a physical fight.” The same witness told investigators Carbajal began chasing the deputy, who appeared to be trying to get away before the officer made an unsuccessful attempt to use his Taser to subdue the much larger man. After about a minute, the witness indicated the officer fired two or three shots from his handgun, which caused Carbajal to fall to his knees. The witness then saw the deputy fire one final shot after the man managed to get up and resumed chasing the officer.

The criminal complaint says the deputy told investigators that "he just kept coming at me." The deputy and Carbajal were both transported to a hospital for treatment. The court document says medical records indicated the deputy suffered a broken foot as a result of the assault by Carbajal.

The initial report on the incident from the Red Wing Police Department stated the man was suicidal.

Carbajal is scheduled to return to court for an evidentiary hearing on December 21.
