A woman told investigators the victim called her and described the alleged sexual assault. The complaint indicates the woman heard a similar account to the one the victim gave during her interview in April.
Burns spoke with Rochester police in May. He denied sexually touching the victim.
The complaint says Burns also told police he had been in treatment and was scheduled to be released on April 1 of this year but left three days early.
Police determined Burns was discharged from a treatment facility on March 27. The complaint does describe the type of treatment offered at the unnamed facility and does not say why Burns was there.
Burns is being charged via summons. He’s due to make his first court appearance in December.
